The couple have now been brought before a court which confirmed that they will remain in investigative custody.
The woman involved has not been named and is currently being treated by a team of specialists from the Spanish Civil Guard who picked her up from the hospital.
Police said they are working with her to make sure the complaint is filed and will then take her to Palma airport so she can return to her family in the UK.

It comes just days after a British tourist was detained at Palma Mallorca airport after allegedly raping his girlfriend at her hotel on the Spanish island.
The 38-year-old man was held up while trying to fly home after his 24-year-old partner went to police to say he had forced himself on her in the bathroom of their hotel room.
The couple are said to have been staying at a three-star hotel near the tourist center of Magaluf when the incident allegedly took place.
Meanwhile, in May, a British tourist was arrested on suspicion of raping a friend of her son’s in a hotel in Magaluf.
The vacationer was also detained at the Palma airport after allegedly packing his bags and trying to leave the island in a hurry hours later.
The woman, who is also believed to be British, told detectives she was raped after falling asleep in her friend’s room, which had an internal door leading to her father’s room.
The older man is said to have surprised her in the middle of the night after entering the room while her son was partying.
The alleged rape victim, believed to be in her 20s, fled the anonymous hotel and raised the alarm at a Civil Guard office near the Punta Ballena party track in Magaluf, according to local reports.
